Will My Bankruptcy Petition Be Approved?


This is a valid question that gets asked a lot, but bankruptcy petitions aren’t subject to approval or disapproval. It’s not like a loan where you put in your application and hope the lender gives you the money. Rather, your eligibility is determined ahead of time and are set by the guidelines of bankruptcy law.  Your bankruptcy attorney (if he or she is good) will be able to tell you even before you file (and before you pay any fees) if you are qualified for bankruptcy and what debts will be discharged.

You are going to know long before you appear in bankruptcy court whether or not your case is valid, so there is no waiting to see if you are approved.  Your attorney will have reviewed your claim before filing and will already know the outcome – no chance of being disapproved!
